Penanti results – Mansor wins with 5,558 majority, Aminah loses deposit.

 Dr. Mansor Osman has won the Penanti state election with an overwhelming majoriti of 5,558 votes.

The results are:

Dr. Mansor Osman    : 6,052

Nai-Khan Ari                : 494

Aminah Abdullah       : 392

Kamarul Ramizu          : 56

As expected Dr. Mansor won the Penanti state seat and will be sworn in as the DCM 1 of Penang replacing Fairus.  Within 15 months two assemblymen from Penanti is given the Penang DCM 1 post.  Dr. Mansor is not far away from the votes that Fairus got considering the low voter turnout.  Fairus got 7,346 votes.

All independants lost their deposits as it happened recently in the Bukit Selambau by-election.  Independant Kamarul Ramizu Idris lost his deposit twice within 3 months.

Aminah Abdullah who claimed that PKR has offered bribes in the form of the Penang DCM and state councillor has a lot to answer because there is no reason to bribe her at all.  From the beginning everybody believed that Aminah is going to lose her deposit and today she lost it.  

As I have questioned in an earlier article, on what ground does Aminah feels she is the favorite candidate to win the by-election and pakatan has to offer bribe for her not to contest the by-election.  It doesn’t makes sense at all.  Isn’t it dumb to buy a candidate who lost her deposit with the cost of the Penang DCM post?  Simply ridiculous!

As usual the MACC has gone into silence regarding the investigation of the Aminah’s bribery claim.  The MACC came in lightning speed to investigate but now in limbo.  But, they were vey fast to announce Fairus’s innocence in the Quarry bribery issue since Fairus has quit even before the investigation was over.

A bad day for BN since they expected independant Aminah Abdullah could do some damage to Pakatan Rakyat.  But she didn’t.  In fact, she was damaged since she lost her deposit and finished behind another independat candidate, Nai.  All assistance given to her through the BN’s media is all in vain.  She got the highest postal vote,  another indication that she is BN’s proxy.

Penanti by-election day – a slow start.

- It is reported that till noon, nearly 30% of the N12 penanti voters have  casted their votes.  We must be mindful that a smaller voter turnout can backfire the PKR chances to win the by-lection, that is if we assume the Pakatan voters are complacent and did not come out to vote.

There are news also that 60% of the chinese has casted their votes till noon, a boost for pakatan.  But the chinese votes are only about 25% of the total voters.  We expect only about 50% of the total voters to cast their vote.

- Many voters have complained that their names were not in the voter registeration and others claimed that their names have been transfered to other constituencies.  The EC blames the voters because they did not check their voting status earlier. 

But, how can the EC blame the voters since only the EC can delete or transfer the voters.  If we can’t find  our name in the voter registeration than definitely it is the EC who has deliberately deleted it.  We don’t belief that there are other external sources who can do it.  The EC must be held responsible if there is any manipulation in the voter registeration.

There are also big numbers of police present.  We really do not know the reason since the BN is not contesting and this by-election is a very low-profiled one.  There are claims that their presence is to intimidate the Pakatan voters.  Well, if that is so, who do you think the dark forces behind this wants to win.   Independant Aminah Abdullah?   A BN proxy?

PETALING JAYA, 28 May 2009: The PAS Supporters Club will not be promoted to a wing at the party muktamar (general assembly) which starts on 5 June.

Instead,  the matter is likely to be decided at an emergency assembly to be held later this year.  If PAS admits the club as a dewan or wing, it would be the first Islamist party in the world to grant membership to non-Muslims.

The 50,000-strong club,  which started in 2004,  has been pushing for admission into the party.  This was agreed to in principle at a PAS retreat in November 2008,  and was to be raised as a motion in the coming muktamar.

However,  club president and co-founder Hu Pang Chaw says that the committee formed by the party leadership to study the matter was only set up in April,  too short a time ago to consider the technicalities involved.

These include the question of full or associate membership in PAS,  voting rights and rights to representation in the central working committee.

PAS unity bureau chief Dr Mujahid Yusof Rawa confirmed with The Nut Graph that the club’s admission into the party would be put off till a special muktamar was convened this year so as not to distract from the PAS elections.

Hu said the delay was understandable because of the elections which are shaping up to be a keenly-fought contest, especially for the deputy president’s post.

He is optimistic that the club will be elevated to a wing as non-Muslim support for PAS had been proven in the 2008 general election and in the recent by-elections,  especially in the Bukit Gantang parliamentary by-election which PAS won by a 2,789 -vote majority against Barisan Nasional.

“PAS realises that without non-Muslims,  the party cannot play an important role in Malaysia,” Hu told The Nut Graph.

Unity talks

On muzakarah or unity talks with Umno which has the support of the conservative faction in PAS,  Hu said the majority of club members were against cooperating with Umno.

“They feel that if that is the case, they might as well join MCA, MIC or Gerakan.”

A unity government with Umno was proposed by PAS president Datuk Seri Abdul Hadi Awang,  who retains his post uncontested this year.  Another strong proponent is deputy president Nasharudin Mat Isa,  a religious scholar,  who is being challenged by “liberals” and non-clerics Datuk Husam Musa and Mohamad Sabu in this year’s party elections.

The deputy president’s race is being fought on the muzakarah-with-Umno platform. Husam and Mohamad Sabu are against it while Nasharuddin has been silent in the run-up to the party polls.

Hu recognises that this muktamar will shape the party’s future, given the elections and debate about “leadership by ulama” versus professionals.

Hu said the club had no problems with the party president being led by an ulama, but also wanted professionals in the other positions to ensure a balance of views.

He said the club had received 100 invitations to attend the muktamar next week.

The club will also have its national-level convention in Klang on 30 May. PAS spiritual adviser Datuk Nik Abdul Aziz Nik Mat will launch the convention.

PENANTI, May 28 — PAS spiritual leader Datuk Seri Nik Abdul Aziz joined an all-star ceramah session last night as Pakatan Rakyat stepped up efforts to wrap up the by-election and bag the win.

Nik Aziz went straight for the Barisan Nasional (BN) jugular and mocked prime minister and BN president Datuk Seri Najib Razak’s decision not to allow former communist leader Chin Peng to return to Malaysia, describing it as hypocritical.

“Chin Peng wants to come back and somebody asked me what I thought about it so I said if BN wants to reject the communists, then the same can be said about nationalists,” he said.

The statement was made in reference to his belief and past statement that Umno should replace its nationalist trait with Islam as the main ideology.

Nik Aziz, who vehemently opposes the “cooperation with Umno” idea supported by some of his own party members, had stated in the past that the Islamist party will only work together with its rival if the latter discards its nationalist ideology.

But judging by how the charismatic PAS leader pounded BN last night, this “cooperation” is a long way off.

BN was accused of total evil, reigning with treachery, manipulation and corruption. He urged Penanti voters to rise against the BN rule and vote for PKR candidate Mansor Othman this Sunday.

The other big names at the ceramah were Parti Keadilan Rakyat (PKR) de facto leader Datuk Seri Anwar Ibrahim who also asked voters to send a strong signal to BN.

He also blasted BN for their decision to contest in Manek Urai, slamming the decision as a reflection of their arrogance and hypocrisy.

“When they did not want to contest at Penanti, they said they wanted to focus on improving the country’s economy and not play the political game supposedly created by me.

“But it seems that the economy of the country, in fact the world, has been solved since BN now has the time to contest there,” he said.

The Manek Urai by-election in Kelantan will be the seventh since the March 8 polls. The state seat was vacated following the death of its assemblyman, Ismail Yaakob.

Also present at the ceramah was PKR vice-president Azmin Ali.

PUTRAJAYA: The Election Commission (EC) has set July 6 as nomination day for the Manek Urai state seat by election while polling will take place on July 14.

The nomination and counting centre will be at Dewan Petra, SMK Sultan Yahya Petra I , Kuala Krai.

Nine schools will be used as polling centres.

“The by-election will cost the EC RM400,00 and 350 election workers will be employed,” its chairman Tan Sri Abdul Aziz Mohd Yusof told a press conference on Thursday,

“The EC will set up two election campaign enforcement teams that will oversee the installation of campaign material and activities through the campaigning period.”

He reminded political parties to refrain from campaigning on polling day.

Asked about the fact nomination and polling will be held on weekdays, he said it should not be a problem as most of the constituents were farmers, fishermen and rubber tappers, who were not bound by office hours.

When nomination and polling days are set on weekdays, that means BN is going to contest the seat.  If it is held during the weekend that means BN will not be contesting like the Penanti state by-election.

The seat fell vacant following the death of state assemblyman Ismail Yaacob, who died last Friday after suffering a heart attack.

The Independent candidate for the Penanti state by-election, Aminah Abdullah has denied she had laid a trap for two PKR members to come to her house on May 13.

“Kak Min has cordial relations with both of them and they have always come for ‘makan’, receptions and Hari Raya at my house.

“But I did not invite them on May 13. Instead, one of them had contacted me, wanting to see me.

“No one from PKR contacted me after I left the party in 2007 except for the duo,” she claimed while campaigning in Simpang Tiga Kubang Ulu here on Wednesday.

Aminah, who was the former PKR Wanita chief, has lodged a report with the Malaysian Anti-Corruption Commission (MACC) alleging that two PKR members had offered her RM80,000 and the Penang Deputy Chief Minister 1 post should she win the by-election and rejoin the party.

PKR supreme council member Cheah Kah Peng and an assistant to a state executive councillor, Peter Lim Eng Nam have claimed that they fell into Aminah’s trap as she had invited them to have lunch at her house in Jelutong.

Aminah says that the PKR duo are her cordial friends even after she left PKR and she also agrees that they always come to her house for ‘makan’.  But how come that on 13 May she installed recording devices and camera for pictures to be taken.  How is she so confident that these two men will come to offer bribe to her.  Doesn’t this sounds fishy? 

Who advised her to do all this?  It looks like someone who is an expert  in preparing traps has a hand in this.  Who set up traps for the two assemblymen from Perak, Osman Jailu and Jamluddin until they were caught by the MACC for bribery?

The undisputed answer is umno and BN. Very simple!

All the print media reported that the PKR duo confessed meeting Aminah and bribing her contrary to the alternative or new media which reported that the duo met her but did not offer any form of bribe.  You see how the BN pro-print media playing in favour of Aminah who is suspected of being BN’s proxy in the Penanti by-election.  It looks like there are instructions to print media to how they should report even though BN is not contesting.

The voters in Penanti constitution should be aware of this independant old candidate.  If she can stab the back of whom she called as her cordial friends, so just imagine how dangerous and cunning she is.  

 Just hear how she sweet talks to the PKR duo while she is recording the whole meeting.   Listening to the audio cd, we can conclude that the PKR duo has never brought any specific offers.   We only hear Aminah and her huband trying to make the duo to get some sort of confession.   Very disgusting!

KUALA LUMPUR, May 27 — It’s no secret that PAS vice-president Datuk Husam Musa is no fan of the Dewan Ulama (the party’s religious scholars’ wing). And they, not surprisingly, have been one of his strongest critics.

Husam and another vice-president Mohamad Sabu are challenging two-term deputy president Nasharuddin Mat Isa, who is favoured by the pro-Umno faction, made up of largely ulama in the party.

There have been veiled accusations levelled by the head of the Dewan Ulama against Husam of bribing party members in order to get nominations for the deputy presidency.

And just last weekend the Dewan Ulama organised a seminar, at the old party headquarters in Gombak, with the aim of strengthening the leadership of the religious scholars in the party.

A photo exhibition on the history of PAS was also held and newspaper reports on the takeover of the party by the ulama in 1982 were displayed prominently.

Husam, however, prides himself on being part of the wave that led to the removal of the Malay nationalist PAS president Datuk Asri Muda.

“I joined PAS on the day Datuk Asri stepped down in 1982, I was still a second-year student at Universiti Malaya,” said Husam.

“As a student I did not favour Datuk Asri, because he was more Melayu than Islam, which limits growth. It only divides the Malays between PAS and Umno, but you cannot get support from the rest,” he added.

He attended the party’s muktamar that year at the invitation of a Kelantan ulama, Mustafa Taib.

“Now the ulama is in Umno, but I am still in PAS,” he said with a broad smile.

“That was also the year Anwar Ibrahim joined Umno. If I am called pro-Anwar, that is not fair to me, if I am I would have followed Anwar in 1982,” Husam told The Malaysian Insider.

The Kelantan executive councillor has been called pro-Anwar by his critics due to his support of the opposition coalition Pakatan Rakyat (PR).

He is still motivated by the same thing that led him to contest PAS’s No. 2 — making the party the biggest political force and to replace Umno.

“The incumbent No. 2 seems to have close ties with Umno leaders and he seems not focused on making our party the anchor party,” he said.

“I want to put a stop to activities destructive to the idea of PAS replacing Umno,” added Husam.

“I feel my time in the party is wasted if the party only wants to complement Umno,” he said.

Husam said since the official announcement on Monday he has been getting a lot of text messages supporting his decision to contest.

“I think on the ground there is some of dissatisfaction with what is going on, but PAS members are disciplined, so most of the time they hide their feelings, but they have their own assessment of what is going on,” he said.

He also said he was not worried that the wide publicity given to his candidacy would backfire — as PAS members are known to reject candidates who are too eager to contest.

“If I remain quiet, it is not fair to the members… they need to know my objectives,” said Husam.

“I hope PAS members understand why I am contesting,” he added.

IPOH,  May 26 — In yet another twist to the Pakatan Rakyat (PR) hunger strike,  riot police arrested over a dozen people including eight elected representatives who tried to lead a march from the DAP headquarters to the Ipoh High Court.

The arrests took place after the launch of the planned three-day hunger strike by ousted mentri besar Datuk Seri Nizar Jamaluddin at the DAP headquarters here.

Those arrested include dumped assembly speaker V. Sivakumar, Ipoh Barat MP M. Kulasegaran, Kedah DAP chief Thomas Su and Perak PKR deputy chief Chang Lih Kwang.

Kulasegaran was taken with into the truck with the others despite insisting he was simply “walking” not “marching”.

Meanwhile, the tent was taken down by Ipoh City Hall workers.

Earlier, the light strike force officers moved in at 7am, arresting two local and three Burmese workers from an event management company who were putting up the tent and a giant balloon.

The balloon was also confiscated.

The officers then occupied the tent to block PR from continuing with their fast, which is part of a move to press for fresh elections in the silver state.

At 9.30am, the riot police were still under the tent just outside the DAP Ipoh headquarters and having breakfast.

A total of 40 policemen, two jeeps, four police cars, two vans and seven trucks were seen in the area.

Police later tried to remove the tent point but Perak DAP chief Datuk Ngeh Koo Ham negotiated with them. The police said the tent was an illegal structure but DAP leaders present pleaded with them “not to take sides”.

“If you want to take down illegal structures, there are many in my constituency,” said Su, the Pasir Pinji assemblyman.

In the end, the police stood down and left the tent alone. However, when PR leaders tried to take a group photo, police asked the crowd to disperse, insisting that any gathering outside private premises is illegal.

The crowd has moved on to the Ipoh High Court, where a suit by 817 village committee members appointed by PR is to be filed for wrongful dismissal by the BN government.

Naib Presiden Pas,  Dato Paduka Husam Musa telah mengesahkan bahawa beliau akan bertanding bagi jawatan timbalan presiden pas.

Yang menarik tentang pengesahan beliau adalah sebab yang beliau berikan untuk bertanding jawatan timbalan presiden.  Beliau mengatakan timbalan presiden yang lalu,  YB Nasarudin Mat Isa adalah terlalu liberal.  Ini adalah berkaitan dengan usaha YB Nasarudin membawa pas bekerjasama dengan umno.   

DP Husam telah menjelaskan  kepada  Malaysia Insider,  Pas harus mengantikan umno, bukan berkerjasama.  Beliau juga menegaskan bahawa orang no.2 parti mempunyai hubungan rapat dengan pemimpin-pemimpin umno dan tidak berminat menjadikan pas sebagai parti alternatif bagi umno untuk mewakili umat Islam di Malaysia.  Beliau mengatakan sebab utama beliau bertanding jawatan timbalan presiden ialah untuk menghalang segala usaha-usaha yang dijalankan supaya pas tidak dapat mengantikan umno.  Saya rasa apa yang beliau katakan itu ada kebenarannya.

Dalam Islam kita ada prinsip dan peraturan yang menentukan segala pergerakan dan tindak tanduk kita.  Liberal memberi makna kita tidak terikat kepada mana-mana prinsip dan bolih berubah mengikut kehendak kita.  Kalau hari ini kita rasa hendak ikut umno, kita bolih ikut.  Jika esok kita rasa nak ikut Benyamin Netanyahu kita bolih ikut.  Jadi, konsep liberal adalah sangat bahaya.

Langkah yang diambil olih DP Husam Musa harus di sokong penuh olih seluruh ahli pas.  Prinsip Islam sangat penting.  Umno tidak penting.  Pas mesti berdiri atas landasan Islam dalam meneruskan perjuangannya.  Apabila Pas  hendak berkerjasama dengan mana-mana pihak, ia mestilah berlandaskan prinsip perjuangan Islam. 

Apakah yang Pas dapat sekiranya Pas meneruskan kerjasama ini?  Mungkin pemimpin Pas akan dapat beberapa jawatan menteri kabinet dan dapat bergaul dengan golongan elit umno.  Adakah ini memadai bagi Pas dengan  mengorbankan perjuangan Islam?

Mungkin bagi YB Nasarudin dan mereka yang sealiran dengan beliau akan berpuas hati dengan ganjaran tadi.  Tetapi, perjuangan Islam sudah pun Pas gadaikan.  Kalau Pas dah bersama-sama dengan umno,  apa lagi yang hendak Pas berjuang? 

Umno adalah parti yang sangat zalim.  Inilah yang selalu disebutkan olih seluruh ahli pas termasuk Nasarudin dan aliran pro-muzakarah sebelum ini. Kalau sudah berkawan dengan parti yang zalim, bagaimana Pas hendak menentang kezaliman. 

Dalam pilihanraya umum yang ke12 tahun lepas, umno telah mengalami kekalahan yang paling teruk dalam sejarahnya.  Pas telah kempen dengan hebat dengan mengandaikan umno tidak lagi relevan dalam politik negara.  Jadi, apabila Pas bekerjasama dengan umno, ia hanya akan menguatkan lagi kedudukan umno yang sudah pun lemah.    Seperti yang disebutkan  olih DP Husam,  sebenarnya Pas harus berusaha untuk mengantikan umno bukan mengukuhkannya.  Maka sia-sialah perjuangan pas sebelum ini supaya umno lenyap dari pentas politik negara.   Jadi kita tidak faham langsung apakah ajenda aliran pro-muzakarah ini kerana ia tidak masuk akal langsung!

Apabila Pas bekerjasama dengan pakatan rakyat, ia adalah berdasarkan perjuangan dalam perkara-perkara yang ada persamaan dengan perjuangan Islam, seperti menentang kezaliman,  ketelusan,  menentang fahaman perkauman dan banyak lagi prinsip yang sealiran  dengan perjuangan Pas.  Tapi malangnya umno mempunyai segala ciri-ciri yang bertentangan dengan apa yang saya sebutkan tadi dan dengan ini amatlah sukar bagi  sebuah gerakan Islam seperti Pas bolih bekerjasama dengan mereka.

Bagi saya mereka yang hendak membawa Pas bekerjasama dengan umno tidak lagi relevan dalam Pas, tak kira mereka ini ulama atau golongan professional.  Ramai pemimpin pas terdahulu pernah meninggalkan Pas dan menyertai parti lain termasuk umno.  Diantara nya ialah bekas Presiden serta seorang daripada pengasas pertubuhan parti Pas, Tuan Hj.  Ahmad Fuad, bekas presiden Pas, Datuk Hj. Asri Muda dan Hj. Nakhaie Hj. Ahmad.

Kita harap semua pemimpin dan ahli Pas dapat memikirkan semula tentang perkara ini dan dapat kembalikan perjuangan Pas kelandasan seperti mana ia berada  sebelum timbul kekecohan ini.    Allahu Akbar!

Is Aminah the proxy of the BN in the Penanti state by-election?  The way she is unfolding her campaign in Penanti points that there is  BN’s assistance in her campaign strategy.

Yesterday she made a few claims against PKR.   Independent candidate Aminah Abdullah claimed she had been offered the post of Penang Municipal Council president and RM80,000 in compensation if she would withdraw from the May 30 Penanti by-election. 

If she did contest and won, she would have been given the Deputy Chief Minister 1 post, she claimed at a press conference at her makeshift election centre in Kubang Ulu here Monday morning.

Aminah said that two “top PKR leaders” had approached her at her home in Jelutong on May 13 to make the offers, which she alleged had come with the blessings of PKR leader Datuk Seri Anwar Ibrahim.

Claiming she had as evidence, audio on CD and a video-clip on a handphone, Aminah, 56, said she would be lodging a report with the Election Commission on Tuesday at 11am.

The Deputy Chief Minister 1 post and Penanti state seat were left vacant by Mohamed Fairus Khairudin earlier this year while he was under investigation by the Malaysian Anti-Corruption Commission (MACC) for alleged corruption.  The MACC has since cleared him of any wrongdoing, but Fairus said he now wants to further his studies.

All her allegations looked very well planned.  There were allegations like this against PKR in the Bkt. Selambau by-election also.

Where did PKR get that much money to bribe Aminah.  Her actions interprets her anger and revenge towards Anwar Ibrahim and the PKR.  Even before her allegations, when she first mentioned that she will contest the Penanti by-election, she claimed that she will reveal the wrong doings of PKR under Anwar’s leadership.

She did not produce all the evidents that she claims to be in her possession to the press yesterday where the press will be the best avenue for her to revenge DS Anwar Ibrahim.  She says all the evidents will be produced to the Election Commission when everybody knows that the EC is also a proxy to the BN like her.  She also claims that she has an audio cd to prove that PKR members had met and  induce her to bribery.  

BN did not want to contest the Penanti by-election because they knew they will lose.  Now, on what ground does Aminah feels that she is the favorite and PKR has to bribe her to withdraw from the contest when even the mighty BN has surrendered?  Why must the PKR give her the DCM post if their candidate loses in the Penanti by-election when there are so many other assemblymen in pakatan rakyat who can be offered that post?  All these doesn’t make sense which means the existence of the dark hidden hand of BN is very evident.

There were unconfirmed news that several BN agents have met her before nomination day and offered to assist her financially and strategically in the by-election.  The BN’s calculation is very simple.  They expect BN voters to vote for her since BN is not contesting and consider  her as the strongest independant opponent to face the pakatan candidate, while they also believe that some of PKR voters also will vote for her since she was a former Penang wanita PKR leader and win.  They expect pakatan voters will become  complacent which will bring down pakatan voters turnout on election day.  So, in this way BN will be happy if Aminah can defeat Dr. Mansor and they won’t lose face if she is defeated.

We can see now the BN media are all giving full coverage in favour of her campaign.  She is getting all the attention from the media that BN would have got.  The MACC is also very steadfast in assisting the Independant candidate and all this points that Aminah is BN’s proxy candidate.

I hope PKR has to weather this problem strategically since BN could be involved.

The Star) – Former Perak Mentri Besar Datuk Seri Mohammad Nizar Jamaluddin and Tronoh assemblyman V. Sivakumar will lead a hunger strike calling for the dissolution of the state assembly.

Revealing this, Perak DAP secretary Nga Kor Ming said the two men would join Pakatan Rakyat supporters in the hunger strike to be launched on Tuesday at Wisma DAP here.

The strike was meant to last at least three days, but those who were willing to continue could do so, said Nga.

The peaceful campaign, he said, was meant to send a serious message asking that the people be given the right to choose their leaders.

“A democratic government must receive the mandate from the rakyat. The people do not want a government to be dictated by a judge only,” he told a press conference at Wisma DAP Saturday.

Nga argued that the state Barisan Nasional government had no moral basis to administer the state as it was relying on three state assemblymen who had supposedly “betrayed” the will of the people.

He invited the public to turn up for the three-day event, even for those not fasting, as it would include talks and a signature campaign.

Nga said among the DAP, PAS and PKR leaders joining in the hunger strike were himself, Pasir Pinji assemblyman Thomas Su, Titi Serong assemblyman Dr Khalil Idham Lim Abdullah and Simpang Pulai assemblyman Chan Ming Kai.

“The public is urged to wear black as a sign of protest against the undemocratic power grab by Barisan,” he said.

Participants must first sign a pledge with guidelines stating that one could take part after checking with one’s doctor, with a liquid break to be taken every six hours.

The guidelines added that one could fast according to their faith, such as Muslims could fast from sunrise to sunset.

Ipoh Barat MP M. Kulasegaran called for the setting up of a constitutional court to specifically deal with constitutional and political crisis, such as in India and Thailand.

BUKIT MERTAJAM:  It is a four-cornered fight for the Penanti by-election on May 31.The candidates were PKR’s Mansor Othman and three independents – former Penang PKR Wanita chief Aminah Abdullah, company manager Nai-Khan Ari, 41, and motivational expert Kamarul Ramizu Idris, 42.

Returning officer Roslan Yahaya announced this at noon today.

Nomination papers from independent businessman Mohd Saberi Othman, 49, were not accepted.

When asked, Roslan told reporters that Mohd Saberi had not fulfilled all the conditions required for him to stand as candidate in Penanti but declined to elaborate further.

Attempts to get Mohd Saberi for his comments were unsuccessful.

Earlier, Mohd Saberi had joined the other four candidates in filing his nomination papers at the Youth Skills Development Institute here.

Six objections were raised during the objection period, including one against Kamarul’s proposer, who is said to be not from Penanti.

Kamarul has stood as an independent and lost in the Bukit Gantang parliamentary against by-election.

The nomination process for the Penanti by-election was quieter than the other polls held previously.

Although some Pakatan Rakyat supporters have turned up at the nomination centre at the Youth Skills Development Institute here today, there was no taunting and shouting that have marred other by-elections.

However, the police were not taking any chance.

A police helicopter was spotted circling above the area while some 300 personnel have been mobilised to keep watch over the crowds.

The earliest to arrive today was Aminah, who came to the centre at 7.45am.

She was followed by Mohd Saberi and Nai-Kan, then Mansor.

Many of the Pakatan Rakyat leaders have turned up at the centre to give their support to Mansor.

Barisan Nasional has decided on May 18 to sit out on the by-election.

According to the 2008 electoral roll that was updated on April 16, the seat has a total of 15,384 registered voters, including 24 postal voters.

The electorate comprises 72.68% Malays, 24.22% Chinese, 2.39% Indians and 0.71% others.

The Penanti seat fell vacant after Mohammad Fairus Khairuddin quit as assemblyman on April 16 after stepping down as Penang Deputy Chief Minister (DCM) I on April 8.

The appeal court overruled the high court decision that DS Nizar Jamaluddin is the Perakl MB and installed  Datuk Zambry Abd. Kadir as the rightful MB.

The appeal court delivered its verdict just now and contends that the ruler has the right to install a new MB when he feels that the MB of the day has ceased command of the state assembly.

The appeal court’s unanimous decision also claims  that a vote of  confidence is not necessary to oust the reigning MB which means from now on any parties that feel they have the majority, they simply go to the palace and tell their story and the ruler will immediately install a new MB.   The provision in the Perak constitution regarding a vote of confidence in the state assembly to oust a MB (article 16.6) can now be thrown into the dustbin since the appeal court has created a “shortcut” to install a new MB.  So, now the ruler  can simply  ask a MB to resign even if there is no provision in the state constitution.  Well,  this is how the appeal court upholds the rule of law!

It looks like the script  was read out from Zambry’s counsels, Cecil Abraham and Gani Patail’s notebook!

The three-member Bench comprising Justices Md Raus Shariff, Zainun Ali and Ahmad Maarop delivered judgment after hearing submissions from both parties yesterday.

DS Nizars counsel,  Hj. Sulaiman Abdullah had asked for a written judgement.  He says that the case will be appealled in the Federal Court.  But does all these really matters?  I had wrote in an earlier article that once the case moves into Putrajaya, it is a forgone conclusion that DS Nizar will lose.  When the appeal court came at lightning speed to Zambry’s rescue last week, we can easily guess what will be the outcome of this appeal case.  And what can you expect from the Federal court now?  Judges like  Augustine Paul will be on the bench and you expect DS Nizar to go through?

In IPOH, Nizar told  that he had expected such a result, saying, “I’m a bit disappointed but not surprised.”  “Whether the rakyat accepts the decision is another issue. The rakyat should be given the right to decide, not the courts,” he said.  Nizar said he had explained to the people of Perak that Pakatan Rakyat still had its chance at the Federal Court and they should remain calm and patient.

 “We are disappointed but not surprised at the decision.” said former PR Perak executive council member Nga Kor Ming.

He said although they may have lost the legal battle but they had won the hearts of people. “The people will judge the judgement.” He added the courts were not the best way to solve the crisis and itis better to let the people decide.

The DAP’s Lim Kit Siang, who was present in court, said today’s decision could spark more unhappiness with the administration of Datuk Seri Najib Razak.

Najib is seen as the man who engineered the Perak power grab in February that plunged the state into a constitutional crisis.  Lim said the best solution remains the dissolution of the state assembly to pave the way for fresh elections.

Meanwhile, Bar Council president Ragunath Kesavan said the decision seemed to suggest that rulers have more power than what is stated in the constitution.

“This would be a huge burden for the rulers in future situations because they can no longer say that the decision should go to the state assembly,” he explained.

Ragunath added that the decision did not resolve the constitutional issues involved in the Perak fiasco and echoed popular sentiment that it would be best to bring the matter back to the people for a fresh mandate.

 Come on folks, we have to step on reality not democracy.  When BN took over the country, democracy is considered buried.  The judiciary is the tool of the ruling regime to oppress the rakyat and the government elected by them. 

Truly, today is another dark day for Malaysia’s rule of law!

KOTA BARU: Kelantan assemblyman for Manik Urai, Ismail Yaacob, 60, of PAS passed away from complications arising from diabetes at 6am on Friday at the Raja Perempuan Zainab II hospital here.

PAS Elections Director Datuk Nustafa Ali will hold a press conference at 11am at PAS headquarters in Jalan Raja Laut in Kuala Lumpur.

Hospitalised in April, Ismail leaves a wife, Siti Zaharah Ibrahim, and 10 children.

Ismail, who was deputy head of the PAS Kuala Krai Division, is one of the longest-serving PAS elected representatives in Kelantan.

He first won the Manik Urai state seat in 1985 and has held the seat for five terms.

He did not contest the seat in the general election in 2004, paving the way for Zamzuri Mat Lazim to be the elected representative.

Ismail contested the seat again in the general election last year and defeated Mohamed Zulkifli Omar of the Barisan Nasional with a majority of 1,352 votes.

Manik Urai is one of the four state seats in the Kuala Krai parliamentary constituency, the others being Dabung, Guchil and Mengkembang.

PAS, helmed in Kelantan by Menteri Besar Datuk Nik Abdul Aziz Nik Mat, retained Kelantan in the general election last year by winning 38 seats. Barisan won six seats and Parti Keadilan Rakyat, one.

 PUTRAJAYA, May 21 — The Court of Appeal will decide tomorrow if it agrees with the Kuala Lumpur High Court’s ruling that Datuk Seri Nizar Jamaluddin is the rightful Perak mentri besar.

A three men panel heard submissions today from lawyers representing Barisan Nasional’s (BN) Datuk Seri Dr Zambry Abd Kadir and Pakatan Rakyat’s (PR) Nizar,  in what was a repeat of the protracted trial in the High Court.

Both teams put forward the same arguments they made during the high court case.

Zambry’s team arguing that Article 16 (6) of the Perak constitution allowed the state ruler to ask the MB to resign if he is deemed to have lost the confidence of the state assembly.

Nizar’s lawyers contended that a state chief executive can only be deemed to have lost the confidence of the legislature through a vote in the state assembly.
Justice Raus Shariff says question before court is whether the trial judge had interpreted the Perak Constitution correctly.

“If wrong, the appeal will be allowed,  if right, the appeal will be dismissed,” he said.

The following day Zambry filed an appeal and obtained a stay order from Court of Appeal judge Ramly Ali who had sat as a single judge.

Following this Nizar filed his own application to set aside the stay order granted to Zambry.

Nizar’s application is to set aside the stay order obtained by Zambry against the High Court ruling which had declared Nizar as the legitimate mentri besar.

He had also requested that the matter be heard by a five-member Court of Appeal panel, instead of the usual three, as it was a matter of public interest and touched on constitutional issues.

However,  Nizar failed to get his request. It is learnt that his letter of request did not reach the Court of Appeal president Alauddin Md Sheriff on time.

This morning, the parties agreed that Zambry’s appeal will be heard first.

The three-member panel hearing the matter comprises Justices Abdul Raus Sharif, Datuk Zainun Ali and Ahmad Maarop.

This legal battle between Nizar and Zambry is largely seen by many as the final judicial attempt by either party to stamp their authority as the rightful and legitimate Perak menteri besar.

The hearing is expected to take a few days before the court makes a ruling on both the matters before it.

The hearing began with Zambry’s counsel Datuk Cecil Abraham arguing that High Court judge Abdul Aziz Ab Rahim had not given proper weight to the evidence produced on the legality of Zambry’s appointment.

Cecil said the evidence had showed that the Sultan of Perak had ordered Nizar to resign which the latter had refused to do so.

The constitutional provision provides that Nizar resign following the Sultan’s directive, said counsel.

Cecil said the Ruler was only exercising his royal prerogative under Article 16(6) of the Perak constitution to reject Nizar’s request for the assembly to be dissolved.

Attorney-General Tan Sri Abdul Gani Patail, who has intervened in the matter to assist the court, started his submissions after Cecil ended his.

Gani said there were no provisions under the Perak constitution for a mentri besar to be voted out through a vote of no confidence to show that he had lost the majority in the House.

He argued that if the mentri besar had lost the confidence of the House, he must resign.

Nizar’s lawyer Sulaiman Abdullah submitted after the lunch break.

He said that there was no provision in the state constitution that gave express power for the sultan to sack a mentri besar.

He argued that the Sultan could dismiss the state exco but not the MB.

Tomorrow the appeal court will preside to listen to Zambry’ and Nizar’s appeal at the palace of justice in Putrajaya.

DS Nizar is appealing to put aside the ruling by justice Datuk Ramli Ali who granted a stay of execution in favour of Zambry last week.  While Zambry is appealing against the high court ruling by Justice Abdul Aziz Abdul Rahim that DS Nizar Jamaludin is the lawful Perak MB.

Both the appeal cases will be heard on the same day.  Nizar’s counsel Amer Hamzah Arshad said he hoped that the court would hear the appeal against the High Court’s decision first as the “stay of execution order would become academic” after the court rules on the appeal.

Both Nizar and Zambry have been embroiled in a legal battle since Feb, when Zambry was appointed as mentri besar, with both claiming office to the state’s chief executive position.

On Feb 13, Nizar filed for a judicial review against Zambry’s appointment, seeking a declaration that he was the rightful Perak mentri besar “at all material times”, and an injunction to bar Zambry from carrying out the duties of the MB.

On Monday, the High Court ruled in favour of Nizar, declaring that his office had not been vacated, rendering Zambry’s appointment as null and void.

Following an application by Zambry, the Court of Appeal ruled on last Tuesday that he remained the Perak Mentri Besar until his appeal against the High Court ruling was disposed of.

Nizar is seeking a five-man bench to discharge the Court of Appeal’s order which was handed down by Justice Ramly Ali. Hearing was initially fixed for Monday and later postponed to Thursday.

Now the question is what should we expect from the appeal court?.  Will the appeal court stand by the high court ruling?  It is very difficult to guess.  BN wants the apeal court to reinstate Zambry as the Perak MB.  I won’t be suprised if Zambry is reinstated against the high court ruling.

Recently the Federal Court intervened the legislative powers when it ruled the right and priviledge committee of the Perak state assembly has no right to suspend Zambry and his excos.  The Perak constitution clearly mentions that anything said in the state assembly or any decision taken by any committees cannot be questioned in any court of law.  But the Federal court blatantly disregarded the rule of law.

If this is taken into consideration, then DS Nizar’s chances of coming out unbruised from this appeal court hearing is very bleak.  Can the courts ignore the will of the mighty executives?

There are news that the BN want’s to command the Perak state assembly before it eventually call for the disslolving of the State assembly. This is to make sure that BN is the caretaker government if a snap election is held.  This will put all state machinery under it’s power and will be an advantage for BN.

But all these are unconfirmed news.  But if Zambry is reinstated I am sure the BN will immediately convene an assembly sitting to remove DS Nizar as the rightful MB.  This is what they are waiting for.

I am asked to advise V. Sivakumar, the Speaker of the Legislative Assembly of the State of Perak, on the constitutionality of his purported removal on May 7, 2009.

1. It is common ground that the Legislative Assembly was summoned that day by His Royal Highness, the Sultan of Perak (“HRH”) pursuant to Article 36(1) of the Constitution of Perak.
It is also not in dispute that the meeting on May 7, 2009 was the First Sitting of the Second Session of the 12th Legislative Assembly of Perak, marking the commencement of the 2nd session of a five-year Parliamentary term.

A. FACTS
2. Sivakumar’s alleged removal must be seen in the context of the extraordinary events that took place on the floor of the Assembly on May 7 2009. As to what occurred, I have relied on the live coverage of the events as reported in Malaysiakini, and the Chronology of Events published in the May 8 issue of the Sun newspaper. Hopefully, a combined reading of these 2 contemporary accounts would present an accurate summary of the facts. The time-line, as I understand it, is set out in Appendix A hereto.
3. From the facts narrated in Appendix A, it is clear that:-
(i) Sivakumar took the Speaker’s chair, Pakatan occupied the government bench (that is, on the right of the Speaker) and BN sat on the opposition bench (that is, on the left of the Speaker) when the Assembly was ready to start proceedings at about 10.00am on May 7;
(ii) The Speaker ordered 10 assemblymen to leave the Assembly;
(iii) The said 10 Assemblymen refused to leave;
(iv) The Speaker therefore did not start the meeting;
(v) The Speaker was forcibly removed from his chair;
(vi) Ganesan purported to act as replacement Speaker, purportedly after being elected;
(vii) Some five hours after the scheduled hour, and after the Speaker’s forced removal, the Raja Muda of Perak (“RM”) delivered the royal address;
(viii) Ganesan thereafter adjourned the sitting sine die; and
(ix) The Assembly has not sat since that adjournment.
4. On these facts, the critical issue in law is: when was this session of the Assembly opened? In other words, when was the Assembly in a position to transact business and take legally binding decisions?

B. WHEN DID THE SESSION OPEN?
5. As stated in Paragraph 1 above, the May 7 sitting was summoned by HRH under Article 36(1). It was the 1st Sitting of the 2nd Session of the 12th Legislative Assembly. In such circumstances, when did the Sitting begin?
Prima facie, two Standing Orders (“SO”) may be of indirect assistance. The Standing Orders were enacted in 1998 by the Legislative Assembly of Perak pursuant to Article 44(1) of the Perak State Constitution. They have the force of law.
First, SO 1, which deals with the proceedings of the first meeting of the Assembly after a State Election, reads: “On the first day of the meeting of the Assembly after a State General Election, members having assembled at the time and place duly appointed and being seated in accordance with the provisions of Standing Order 2, the Secretary of the Assembly shall read the Proclamation of His Highness Paduka Seri Sultan Perak Darul Ridzuan by which the meeting was summoned, and thereafter the order of business on such day shall be….”
SO 1 contemplates HRH not gracing the 1st sitting of the 1st Session. If HRH however attends, then HRH reads the Proclamation and gives a royal address. Only thereafter is the order of business for the day. However, SO 1 has no application to the sitting on May 7 2009 because it was NOT the first sitting after the General Elections.
6. Secondly, SO 13, which relates to the order of business on ordinary sitting days, reads: “Order of Business … “13(1) Unless the Assembly otherwise directs, the business of each sitting shall be transacted in the following order:-
(a) Formal entry of Mr Speaker;
(b) Prayers;
(c) Taking of oath by any new member;
(d) Messages from HRH;
(e) Announcement by Mr Speaker
(f) Petitions;
(g) to (p) – specific matters which are not relevant for present purposes.
(2) The Assembly may, upon a motion to be moved by the Menteri Besar or in his absence a member of the State Executive Council to be decided without amendment or debate which may be made without notice and shall take precedence over all other business, decide to proceed to any particular business out of the regular order.
The sitting on May 7 2009 was not an ordinary sitting. It was the 1st sitting of the 2nd Session, summoned under Article 36(1) of the Perak Constitution, and was graced by the RM, representing HRH. In consequence, neither SO is, on close scrutiny, applicable to the May 7 sitting.
In any event, any direction on the order of business made under SO 13(1) or (2) can only be by an Assembly that had lawfully opened for business.
7. Accordingly, in my opinion there is no express SO that deals with the May 7 sitting. In such event, reliance can be placed on SO 90 which allows Commonwealth Parliamentary practice and usage to be used as guidance on issues where the SO’s are silent.
Thus, it is proper to consider the practice of the British Parliament. Erskine May’s Treatise on the Law, Privileges, Proceedings and Usage of Parliament is the authoritative and leading text on Parliamentary procedure in the Commonwealth. The learned authors of the 23rd Edition (2004) state: “In every session but the first of a Parliament, as there is no election of a Speaker, nor any general swearing of members, the session is opened at once by the Queen’s speech, without any preliminary proceedings in either House. Until the causes of summons are declared by the Queen, either in person, or by commission, neither House can proceed with any public business…….. …….This practice is observed because no business can be transacted until Parliament has been opened by the Crown” (my emphasis)
8. The learned commentators of Halsbury’s Laws of England state: “(v) Proceedings at the Opening of Parliament … 713 The Queen’s Speech
Neither House of Parliament can proceed with any public business until the session has been opened either by the monarch in person or by Lords Commissioners acting on her behalf. On this occasion the causes for the summoning of Parliament are communicated to the two Houses in the Queen’s Speech,…. In the first session of a new Parliament the Speech is not delivered until a Speaker of the House of Commons has been elected and an opportunity has been given to members of both Houses to take the oath. In each subsequent session there are no such preliminary proceedings and the Speech is delivered on the first day….” (my emphasis)
“717 Proceedings in the House of Commons after the opening of Parliament
After the opening of Parliament, the House of Commons resumes its sitting at 2.30pm. Various sessional orders are made …; certain other business may also be transacted….”
9. Finally, Griffith and Ryle on Parliament : Functions, Practice & Procedures.” (2nd Ed. 2003) takes the same position:- “The Speech having been read, the Queen and her courtiers depart; the Commons return to their Chamber and the Lords remain in theirs. Both Houses area now free to proceed with the work of the session, because no business can be transacted until Parliament has been opened by the Crown”. (my emphasis)
10. Accordingly, in law, the first session of any Legislative Assembly of Perak summoned under Article 36(1) cannot transact any business or pass any resolution prior to the royal address, which on May 7 2009, was only delivered between 3.16 pm and 3.47 pm. Thus, any purported resolutions or decisions taken before the royal address are null and void and of no legal effect.
The importance in law of the commencement of a parliamentary sitting reflects the practice of any meeting of any body or organisation, whether a company, society, union or club. Even in such bodies, until the Chairman of the meeting calls it to order, the meeting cannot transact any business. Any purported business transacted before the chair begins a meeting are of no legal effect.
The law of meeting reflects common sense. It is, therefore, not surprising that Parliamentary practice and usage is also similar.
11. It is not in factual dispute that the purported resolution to remove Sivakumar as Speaker was purportedly passed at about 10.30am on May 7, 2009, well before the royal address. The legal power to remove the Speaker is found in Article 36A(2)(d) of the Perak State Constitution.
The purported resolution to remove Sivakumar presented by BN assemblymen therefore had to be submitted under Article 36A(2), which states that the Speaker shall vacate his office – “(d) if the Assembly at any time so resolves.” It is a condition precedent for an Assembly to pass a resolution under Article 36A(2)(d) that that Assembly must have been “opened” and was in a legal position to transact business, including deliberating and passing such a resolution.
In other words, the House must be sitting legally. Because the Assembly was not “opened” at 10.30am on May 7 2009, the Assembly could not under the Constitution pass the resolution pursuant to Article 36(2)(d).
In consequence, Speaker Sivakumar was not lawfully removed on May 7 2009, and continues, under the Constitution and in law, to be the sole, lawful Speaker of the Legislative Assembly of Perak.

The BN conceded defeat in the Penanti state by-election today.

The election ‘fobia’ Tun Najib Tun Razak announced in a news conference after chairing the BN supreme council meeting.  “We feel it is an unnecessary by-election;  we will not join in the Opposition’s political games,” said Najib.  He feels  this  is a good reason for him to save himself from a defeat in the by-election.

The Penanti state seat fell vacant on April 17 following the resignation of its PKR assemblyman,  Mohammad Fairus Khairuddin.  The Election Commission has set May 23 for nominations.  Pakatan will be fielding former Penang PKR chairman Dr Mansor Othman in the contest.

This is the first time the umno and BN refused to contest in a by-election since independance.   All the reasons given for not contesting in Penanti by-election are very vague but all point towards Najib wants to avoid a contest where his party will be defeated.

This is not the first time Tun Najib dare not contest an election.   He had played an important role to avoid the Perak state assembly to be dissolved hence avoiding a snap election in the state. 

The appeal court demonstrated it when Justice Datuk Ramly Ali’s reason for granting a stay of execution in favour of Zambry (high court ruling that DS Nizar is the rightful Perak MB) was that DS Nizar will ask the palace to dissolve the state assembly and Perak state election have to be held eventually.   Dr. Mahathir had said BN’s defeat in Perak is a foregone conclusion in a snap election.

How long will this BN’s election fobia continue?  What happens when Tun Najib feels that BN’s defeat is unavoidable in the next 13th general elections  when the time comes?

The Perak Palace should  dissolve the Perak state assembly  immediately.  All Malaysians wants the assembly to be dissolved.  Polls taken by the main stream media clearly shows that the rakyat is fed up with the current state situation.

I am very sure there are no other options then dissolving the state assembly.  Malaysians have given their wishes on this.  Tun Najib always pointed out that it is the Sultan’s prerogative to dissolve the state assembly.   Pakatan leaders have also wanted the state assembly to be dissolved.

Tuanku, it is now in  your hand to do what is necessary for the state.  The rakyat and their leaders have spoken.   Daulat Tuanku!

KEWUJUDAN PAS dalam lanskap politik negara,  tidak lagi dikesampingkan.  Selepas 54 tahun PAS mampu duduk sama tinggi dengan parti utama. Maka tidak hairanlah setiap kali menjelang muktamar,  pelbagai polemik dicetus media.  Ia bertujuan memperlihatkan kecamuk PAS dari luar. Antara isu yang diungkit berkaitan golongan ulama,  profesional dan unity government.  Bagi memahami situasi sebenar ikuti pandangan Mursyidul Am PAS, Tuan Guru Dato’ Nik Abdul Aziz Nik Mat ketika ditemui di pejabatnya Selasa lalu.

Nampaknya isu golongan ulama dan profesional dalam PAS diperdebatkan secara terbuka di media sekarang. Bagaimana Tuan Guru melihat situasi ini?

Sepatutnya tidak berlaku pengasingan di antara ulama dan profesional. Tetapi pengasingan berlaku juga hasil daripada penjajahan barat yang mengasingkan agama dan politik.  Sampai kita terbawa-bawa dengan isu tersebut.  Bukan sekadar berlaku di Malaysia tetapi di negara Arab juga.  Negara Arab dijajah Perancis.

Penjajah mengasingkan agama dan politik.  Mereka sebarkan kefahaman itu di sekolah sehingga ke universiti. Dan apabila penjajah pulang negara bekas jajahan yang tidak kuat pengaruh agama terpengaruh juga menerima agama lain dan politik lain.  Sedangkan agama dan politik adalah perkara yang satu tidak boleh diasing-asingkan.

Dalam al Quran Allah Taala menyebut dalam surah Fathir ayat 27 yang bermaksud Allah turunkan air dari langit sehingga keluar buah-buahan dari perut bumi dengan bermacam warna dan beraneka rasa.  Dan ayat 28 pula bermaksud orang yang gerun kepada Allah ialah ulama.  Ini bermakna ulama tidak bererti hanya mengajar fiqah sahaja tetapi pandai juga mentadbir.  Misalnya air yang diturunkan dari langit ini ada kaitan dengan ilmu astronomi.

Ulama kena tahu kedudukan langit.  Hujan turun dari langit ke bumi. Air yang turun ditampung oleh udara menyebabkan hujan yang turun bertitik-titik dan tidak segumpal jatuh di atas kepala kita. Ini bermakna ulama dan profesional adalah orang yang sama.

Di Kelantan kita banyak buka pengajian agama.  Dan sekarang kita buat Maahad Tahfiz Sains, di mana anak kita hafal al Quran dan tahu ilmu sains.  Kita hendak lahirkan pelajar yang ada ilmu agama dan sains.  Dan 20 atau 30 tahun akan datang penghulu kampung sehingga ketua jajahan dan menteri besar adalah mereka yang hafal al Quran dan tahu bidang sains.

Pandangan sesetengah pemimpin menyebabkan penyokong di akar umbi tidak faham?

Sepatutnya tidak berlaku kekecohan seperti sekarang kerana kita sudah lama gabungkan ulama dan profesional.  Kita sudah lama gabungkan di antara ulama dan profesional.  Saya tidak faham kerana apa pula timbul cerita ini.  Ada sesuatu macam kena kecek (pengaruhi).  Mungkin mereka terpengaruh dengan pihak lawan.

Di Kelantan PAS jauh ke hadapan berbanding dengan Umno untuk menawan hati rakyat khasnya nonMuslim.  Kita sebut orang Melayu,  Cina, India,  Siam adalah serupa kerana kita manusia belaka.  Maka tidak timbul hendak letak kelompok-kelompok tertentu. Dalam solat kita sebut ‘Maliki Yaul Middi’ – pembalasan di akhirat kelak dia tidak kira perlembagaan Malaysia ke,  Inggeris,  Greek tua atau apa-apa sahaja.  Allah Taala hanya kira perlembagaan yang Dia buat iaitu al Quran.

Ulama mesti tahu segala-galanya.  Orang yang hendak pimpin sama ada hendak sebut nama Ikwan, Jemaah Islam ke atau apa sahaja perlu tahu agama dan agama itu bermaksud tahu juga akademik.  Akademik bermaksud menerangkan kekuasaan Allah. Bagaimanapun proses Allah menurunkan air alim ulama kena tahu.  Dan air menyuburkan pokok sehingga mengeluarkan buah yang bermacam-macam rasa.  Saya tidak faham kenapa hendak kecoh sekarang.

Kebiasaannya ulama dianggap hanya mereka yang berpendidikan agama?

Itu fahaman lama ketika agama Islam masuk ke Tanah Melayu,  orang yang mengajar agama tidak banyak tahu ilmu akademik.  Sumber ilmu yang diambil di Makkah tidak banyak bidang akademik.  Bagaimanapun sekarang di Makkah dan di mana sahaja ada bermacam-macam ilmu akademik.  Al Quran dia hafal dan akademik pun tahu. Generasi baru sekarang menerajui gerakan Islam.

Apa pula maksud profesional?

Pada tanggapan saya orang yang belajar ilmu akademik.  Akademik itu ilmu Allah juga.  Siapa rajin dia dapat. Di Kelantan pada peringkat awal institusi pondok mengajar masyarakat pandai agama.  Selepas itu berkembang menjadi Jami’ Merbau di mana ilmu pengajian lebih banyak berbanding pondok.  Selepas itu ditingkatkan lagi menjadi Maahad Muhammadi dan perkembangan ilmu semakin meluas.  Secara jelas di sini,  apabila disebut ulama akan termasuk sama bidang akademik.

Bolehkah dikatakan pakar ekonomi dan bidang lain dikenali sebagai ulama memandangkan pengetahuan agama pun ada?

Kalau tidak tahu Islam, tidak bolehkan hendak dikatakan sebagai ulama.  Mereka yang sokong PAS tetapi tidak ada ilmu agama,  kita tidak boleh lantik sebagai pemimpin. Misalnya kalau kita hendak bawa kapal di laut,  bukan sekadar pegang stereng sahaja tetapi kena tahu pelbagai perkara mengenai laut.  Dia kena ada pengetahuan mengenai awan,  cahaya matahari dan keadaan laut.  Orang yang hendak jaga negeri mesti ada asas agama.

Di Kelantan ketika kita mula-mula mentadbir,  saya minta pindahkan wang daripada bank riba ke Bank Islam.  Cara macam mana hendak buat itu orang belajar bidang akademik yang lakukan.  Orang hendak jadi Menteri Besar kena tahu ilmu akademik dan agama.

Barisan anggota Exco yang Tuan Guru lantik sekarang dikategori sebagai ulama?

Katakanlah orang itu tidak belajar di pondok,  tetapi dia duduk lama dengan saya. Dia tengok perangai saya, dia dengar ucapan saya,  dan hadir usrah bersama saya,  macam mana boleh dikatakan tidak belajar agama.  Tidak semestinya belajar di pondok baru boleh dikatakan tahu asas agama.  Mereka semua sudah lama bekerja dengan saya. Sepanjang perkhidmatan itu mereka boleh menimba ilmu agama.  Jadi boleh dikategorikan mereka sebagai ulama juga.

Apa nasihat Tuan Guru mengatasi percanggahan pandangan sekarang?

Saya nasihatkan kita kembali kepada asal.  Ini kerana agama ada jalinan dengan akademik. Dalam Islam ada disebut agama dan daulah.  Ada pun fahaman yang mengatakan agama lain dan politik lain adalah dibawa oleh penjajah.

Kita cuba usaha ranapkan pengaruh penjajah dari sehari ke sehari.  Tidak ada pasal hendak kita timbulkan isu tersebut.  Kita telah lama memilih pemimpin yang ada asas agama. Sekarang nampak kejayaan apabila orang bukan Islam juga sudah tertarik dengan PAS.  Orang Cina yang sokong Pakatan Rakyat sudah pandai beri salam,  sedangkan MCA, MIC sudah lama berkawan dengan Umno,  namun mereka tidak memberi kefahaman Islam kepada bukan Islam.  Generasi orang bukan Islam sekarang sudah ramai berpelajaran.  Dan Islam dari awal lagi menyarankan supaya menuntut ilmu. Islam sesuai dengan akal fikiran manusia.

Sekarang ramai pemimpin tampil merebut jawatan dalam PAS, tidakkah itu boleh menimbulkan masalah?

Mereka yang menawar diri untuk bertanding kerana sudah lama berjuang dalam PAS. Mereka tahu asas-asas Islam.  Dan kita belum dengar ada orang mengkritik calon-calon tersebut tidak sembahyang atau engkar ajaran agama.  Jadi terpulang kepada perwakilan bagi memilihnya.  Saya suka orang tawar diri untuk berkhidmat kepada gerakan Islam.

Pada pandangan Tuan Guru wajarkah jawatan utama dikekalkan?

Kita beri peluang kepada kawasan untuk mencalon dan memilih kecuali kalau ada masalah selepas muktamar kita wujudkan peraturan khusus.

Tidakkah boleh menimbulkan perpecahan dalam PAS?

Kita hendak cari manusia yang tidak berpecah tidak ada.  Allah telah sebut sebelum Nabi Adam dibawa turun ke bumi di mana Allah Taala menyebut ‘Hai Adam apabila kamu turun ke bumi kamu akan bertengkar sesama sendiri.  Bagaimanapun bagi mana-mana orang yang turut hidayah Aku akan senang lenang tanpa ada sebarang masalah.’  Sekarang apabila perwakilan ramai kita memilih menggunakan kertas undi dan tidak lagi angkat tangan.

Sebelum ini media harian menganggap wujud dua kelompok dalam PAS iaitu pro Endorgan dan konvensional. Benarkah demikian?

Itu sekadar tanggapan yang dimainkan media hendak lariskan suratkhabar mereka.  Ada sesetengah wartawan menulis dengan hasrat mahu melaga-lagakan,  dan ada juga wartawan yang lebih berhati-hati kerana mengambil sikap tanggungjawab di dunia dan akhirat.

Dalam PAS hanya ada satu kumpulan yang berjuang untuk mendaulatkan Islam. Perjuangan kita di atas dunia hendak daulatkan Islam dan di akhirat mahu ditempatkan oleh Allah Taala ke dalam syurga.

Baru-baru ini timbul dakwaan dalam blog kononnya Tuan Guru dinasihatkan oleh pembantu yang cuba melagakan dengan Presiden.  Sejauh mana kebenarannya?

Saya sudah tegur orang terbabit.  Hendak cari orang yang tiada silap ini tiada. Orang yang tiada silap langsung ialah kaki lepak yang tidur sepanjang masa.  Kesilapan tersebut maka agama ajar suruh nasihat menasihati antara satu sama lain.

Bagaimana pula dengan isu unity government?

Tidak timbul lagi sekarang kerana Presiden telah menarik balik cadangan tersebut.

Pas should hold on to it’s basic principle, Islam.  The deviation from the original course will lead into disputes.  This is where pas has landed now.

Pas has only two instances to be relevent in local politics and the international arena that is:

1.  Pas hold on to the original idealism of an islamic state and do not cooperate with   other parties which means pas will struggle until an islamic state is established or,

2.  Pas can cooperate with other political  parties who have common principles as  pas like freedom of speech, justice,  transparency etc.

If the first instance is considered, than definitely pas has to struggle alone.  It might be difficult to get the votes necessary to form an Islamic state. 

But if the second instance is considered pas can cooperate with other political parties and this will benefit the party.  More people, muslim and non muslims, will have a chance to understand pas and make the people easy with pas and not be afraid of them.  Strategically this should be the option.

The pakatan rakyat’s common principles are closer to pas’s principle.  So if pas wants to consider the second instance mentioned than everybody can read pakatan will be the right coalition.  Then why did certain pas leaders opt for umno and BN. This is where pas has to be very careful.  Everytime when BN suffers big loses in an election it always talks about malay unity.  Prior to elections before the 12th general election, pas leaders never bought this umno’s argument.  Why is it this time they buy it.  Pas must be very careful with cetain state leaders especially who are former umno members because they have the connection and can be bought over.

It was proved in the 12th general election, pas was voted by muslims and non muslims.  Which means pas can get the votes from all malaysians regardless of their race, religion or ethnicity background.

But now as the Pas party election is looming there is a split among the members. There is this “pro-muzakarah” and the “edrogan” groups. How did this happened?  I personally believe this is due to the deviation of certain leaders from  the principles of the party.  When certain leaders  start talking about racial sentiments, then the cooperation with umno becomes relevant.  This is the main reason behind the split.

This is what led Nik Abduh, a pro-muzakarah to loose his cool.  Islam is a colour blind religion.  In Islam, race, ethnicity and the colour of your skin does not count. If the pas leaders do not want to hold on to this islamic principle then a split among the party members cannot be avoided.

I see that TG Nik Abdul Aziz is consistant with his islamic principles which puts him in high regards among the muslims and non muslims compared to other pas leaders.  This learned islamic scholar,TG Nik Aziz is a strong pillar among the pakatan leadership. And the majority of pas members are behind him.

But I also learned that the majority of the islamic scholars(ulama) among the pas leadership is in the pro-muzakarah group.  This also led to a problem when top posts in the pas leadership could not be challenged by islamic scholars from the edrogan group. 

Recently, the leader of the Pas’s Dewan ulama, Hj. Daud Iraqi, contended that the top two leadership posts, that is the president and deputy president should be filled by an ulama.  This has put Hj. Husam Musa and Hj. Mohd. Sabu who are not ulama have been proposed for the deputy president in a very difficult position.

It looks like the Edrogan group which wants to strengthen the pakatan rakyat coalition will sweep to victory in this coming Pas party election!

As the Perak crisis develops and the call for the crisis to be solved is getting louder,  it is becoming more evident that the crisis is difficult to be solved.

It is very obvious that the Pakatan Rakyat wants to dissolve the Perak state assembly while the BN do not want.   BN wants to rule the state with its three assemblymen majority.   Both Pakatan and BN have 28 assemblymen but BN has the advantage of the three independent but BN friendly assemblymen.

The argument is very simple.   The Pakatan Rakyat feels if the assembly is dissolved, it is confident of winning a bigger majority in a snap election held eventually.  BN knows if a Perak state election is held it is definitely going to lose the state to Pakatan Rakyat.  This is the basis of the current Perak crisis.

Today Mahathir admitted in a press conference, the pakatan rakyat will sweep Perak if fresh elections are held.    He said the outcome of the election is a forgone conclusion.  He asked why should BN want a snap election when it knows it will lose.  He suggested the crisis be solved through a vote of  confidence on the floor of the state assembly.

But Tun Najib’s spin was a bit different.  The basis is the same as Dr. Mahathir but on a smoke screen.  Tun Najib says the Barisan Nasional does not fear fresh elections in Perak and will face the rakyat when the time comes.  Najib said holding fresh elections in Perak was one of the options available to settle the state government issue but it was “not something that has to happen.”  He said the decision was also not Barisan’s to make as the state constitution was clear that only the Sultan of Perak had the power to call for fresh elections should there be a need for one.

According to Dr. Mahathir the BN fears a fresh state election while Tun Najib contends that the BN are not afraid of one.  But both of them wants it to be solved through the state assembly.  I am sure both of them knows however hard they try to solve the crisis without a fresh mandate from the people of the Perak state, the legitimacy of the outcome will be questioned especially if the BN commands the state evetually.

Realistically,  the BN has a three seat majority now in the Perak state assembly.  This is their claim.  Why should the BN go for a snap election when they have this majority.   But if we consider what Dr. Mahthir has said that the people of Perak will give the pakatan an overwhelming majority means the BN is conceding that the people’s voice is not the ultimate priority for them.  Which also means BN does not put the people’s mandate as their upmost priority or the people’s voice is not important. 

It is the power that matters.  They are not willing to concede power by giving  the Perak people the mandate to elect.  But Tun Najib claims,  under the 1 Malaysia policy the people comes first but now the policy proves to be a load of rubbish!

The BN should put the rakyat’s wishes as their top most priority if they want to win back the people’s confidence in them. I do not know why is the BN putting all their money on this short term gain.  If they give back the rakyat of Perak the mandate to choose the goverment of their choice I think, the BN will be respected by all the rakyat.  But as usual, the BN don’t have the wisdom to do so.

Eventhough many BN leaders have called for a fresh election, I don’t think the BN is going to give in.  MCA deputy president, Dr. Chua Soi Lek, BN Gua Musang MP, Tengku Razaleigh, Gerakan leaders, Datuk Teng Hock Nan, Dr. Hsu Dar Ren and Dewan Negara President,  Dr. Hamid Pakwanteh have all called for the Perak assembly to be dissolved.  Even Tun Najib had said today that it is not the BN’s but it is the palace’s prerogative to dissolve the Perak state assembly.

Tun Najib now is putting all the burden of dissolving the Perak state assembly on the palace’s shoulder while the palace is in silence as usual. 

Maybe Tun Najib is bloody sure that the palace will not dissolve the assembly afterall !

Today DS Nizar Jamaludin filed the application to set aside the court of appeal order made yesterday to suspend the high court decision that he is the lawful MB of Perak.

DS Nizar’s lawyers had filed the application together with a certificate of urgency at about 2.30 pm.  They also included a request for a panel of three judges to hear the case.

The appeal court had set Monday, 18th May to hear DS Nizar’s application.  Which means in between today and 18th May there will be
three working days.  If we calculate the actual days then there will be 4 days equal to 96 hours.

Nizar’s application will be heard after 96 hours even though there is a certificate of urgency attached.  But the Appeal court only took 4  hours  to hear Zambry’s appeal over the high court ruling and immediately reinstated Zambry back as the prevailing MB. 

Can we call this as a double standard?  Does the appeal court belongs to umno since the court immediately came to its rescue when the high court ruled against Zambry? I will be booked for contempt of court for saying so.  Then how should I phrase it?  Why is it that it is urgent for DS Zambry but not for DS Nizar.  

For your information the appeal court was presided by judge Dtk. Ramly Mohd. Ali.   Dtk. Ramly was involved in the V.k.  Lingam’s scandal.   Dtk. Ramli was among the three judges mentioned in the V.k. Lingam case other than Dtk. Helilah Mohd. Yusuf and Dtk. Ahmad Maarof to be promoted as judges in 2002.  Actually these judges should have been investigated and sacked.  With a scandal behind him he was just elevated as the appeal court judge on the 15th of April, 2009 and he is the most junior among the appeal court judges.   Just Imagine, the most junior appeal court judge has been assigned for a case of this magnitude. 

Definitely,  Dtk. Ramly owes the umno for protecting him against the scandal and elevating him as  the appeal court judge.    So you know how Zambry got his “stay of execution” within a few hours.

The appeal court gave one of the reason for the stay of execution on Zambry’s appeal yesterday is that if the court don’t do so the rightful MB DS Nizar will ask the palace to dissolve the Perak state assembly.  Why does the appeal court deems this as a very important point in DS Zambry’s appeal.

I want to ask a silly question.  Why is the court so frightened that the Perak assembly will be dissolved?  It is umno and the BN who should be afraid of the dissolving of the assembly because they think they might lose in the state election.  They know the rakyat are not supporting them anymore.  In what way are the BN and appeal  court related?

I doubt DS Nizar can get any justice at Putrajaya since Putrajaya is the home ground for BN. It is difficult to beat them on their home ground.

After the the high court judge, Justice Abdul Aziz Abdul Rahim, ruled that  DS Nizar Jamaludin is the legal MB last Monday,  the status quo of the Perak government is now in a different dimension.

If before this BN and Pakatan claimed their man was the legal MB,  now the high court had cleared their differences.   Since the high court ruled Nizar is the rightful MB,  than Nizar is the MB.  Prior to the ruling DS Zambry,  Tun Najib and Tan Sri Muhyiddin have all contended that everybody should respect the outcome of the high court case.  Now it is all clear.  The high court had already given  it’s verdict.   Does DS Zambry, Tun Najib and Tan Sri muhyiddin accept DS Nizar Jamaludin as the legal MB?

The appeal court granting a stay of execution in favour of  DS Zambry does not change anything.  The appeal court did not overturn the findings of the high court judge,  Justice Abdul Aziz.  The appeal court did not mention anything about the MB’s status.  Thus, the high court ruling is still there that is Nizar jamaludin is still the legal MB.  The scenario changes only if the appeal court overturns the high court verdict.

The Bar Council interpreted the stay of execution as DS Zambry being merely the caretaker government until the appeal is settled in the court. This means the status-quo is no more the same as before the high court ruling.   Before the ruling,  DS Zambry can make decisions regarding government directives and execution but now he can’t.  He just stays as a caretaker MB until the appeal court makes it’s rulings.   Will Zambry abide by these rules?  It is a huge NO!  When did the BN has to follow rules.  They will buldoze through anythng like the 7th May assembly sitting.

Today, while reporting to duty, DS Zambry did not answer questions from the media whether he is the MB now. If before this he always claims that he is the legal MB since the palace installed him, now he does not claim so.  He told the press that they should ask the court.  If this is the case,  he himself is not confident of his present status.  Just imagine Zambry walking into the state building not sure who he is.  It is also reported that he did not go to the MB’s office.

All this points that the high court ruling has changed the dimension of the status quo of the Perak crisis.  Zambry for the time being do not dare to claim himself as the rightful MB.  In the instance that the appeal court quashes the high court decision than the perak crisis will be back to status quo.

Nizar Jamaludin yesterday claimed that he is the rightful MB.  He has all the right now to claim that after the high court ruling.  But the legitimate MB says he do not want to cling on to power.  He prefers to have the state assembly to be dissolved and give the prople of Perak to choose whom they want as their next government.

The Court of Appeal grants Datuk Seri Dr Zambry Abd Kadir his application for a stay of execution on the KL High Court ruling yesterday that declared Datuk Seri Mohammad Nizar Jamaluddin the righful mentri besarof Perak.

This means until the day when the appeal court is going to make a decision on this case,  Zambry will still be the MB.  The Appeal Court in Putrajaya came in lightning speed to give the Perak state government back to Zambry. 

It is not even 24 hours after the high court’s decision that Nizar is the rightful MB.  We also do not know whether the appeal court will retain the high court decision that Nizar is the rightful Perak MB.   Since the case is in the compound of Putrajaya,   I suppose Nizar’s chances are very slim.

In my previous article,  I questioned,  how long is the joyous moment for pakatan rakyat going to last after the high court’s ruling yesterday.   The answer is 21 hours.  Pakatan only ruled the state for 21 hours.   Now Nizar and co. has to vacate the state building again.  All executions directed by Nizar is null and void which means the state secretary and the state legal adviser will be reinstated.

While at the palace,  it seems there were very little developments.  Nizar was in the palace for an official function but I believe he could not do much. The palace again do not want to get involved and settle this crisis once and for all.  It looks like the state assembly will not be dissolved.  Again the oportunity for the palace to redeem it’s earlier decision not to dissolve the state assembly has gone without any appreciation.

The police also are working at lightning speed.  I do not know whose instruction are they taking.  Early this morning they were in droves in front of the Perak state building.  Then it was reported that they reduced their size after 9.00 am.  Immediately after the Appeal court granted the stay of execution in favour of Zambry, the police are back in full force at the state building.

Now all these developments has put the state in a even worst crisis.  There seems little can be done to solve the crisis.  Those who can do it do not care much.

OK folks,  the high court has ruled in favour of the pakatan rakyat.  Nizar Jamaludin is the legal Perak MB for now.  I believe all of you are in a joyous mood.  But let’s pause for a moment and look at a few questions here.

The high court judge,  Justice Abdul Aziz Rahim ruled that former Perak MB,  Nizar Jamaludin is the rightful legitimate MB.  His ruling is based on the fact that, there was no vote of confidene in the Perak state assembly.  He stuck with 1966 federal court decision in the case of the late Sarawak chief minister Datuk Stephen Ningkan that a MB can only be ousted through a vote of no confidence on the floor of the state assembly.

Now,  how long can the joy last?   For now, BN state leaders have announced that they will be abiding the court rulings.   R. Ganeson, the police installed Perak assembly speaker has said he will be calling for an emergency assembly sitting for a no confidence vote on Nizar.   For pakatan,  R. Ganeson is an illegal speaker.   But BN will use this illegal weapon of mass destruction to vote out YB Nizar.  Does BN really cares if the emergency assembly is legitimate or not?   Power must be in their hands by hook or by crook.

Now,  the court ruling means that from the time Zambry was installed as a MB by the palace, till the high court ruling today,  Zambry was not the legal MB but nizar was.  If that is the case,  the motion Zambry tabled for the removal of the speaker on 7th May is questionable because he was never a MB.  Which means R. Ganeson is not a legal speaker, thus,  he cannot call for an emergency sitting for a vote of no confidence.

Many leaders of pakatan,  and NGOs have asked the BN and also the palace to postpone the 7th May sitting,  at least until the court decision on who is the legal MB is ruled by the court.   Since now,  Nizar is the lawful Perak MB now,  all the fracas the pakatan and BN went through in the state assembly is of no any use.   The BN has discredited itself by calling for the state assembly sitting.   The assembly sitting now is illegal and all motions tabled or decision made is worthless.

Datuk Najib today said that an appeal will be made in the court regarding the high court decision.   This means BN is ready to prolong this fiasco.  They are not interested in giving back the mandate to the rakyat.

I think,  this court ruling gives the palace a chance to solve and put the Perak crisis to rest.  YB Nizar Jamaludin has said immediately after this evening’s court decision,  he will be seeking an audiece with the Regent of Perak,  Raja Nazrin to dissolve the state assembly.   The Sultan of Perak is abroad.   Now there is a reason for the palace to get involved and dissolve the state assembly.   But again, will the palace take this opportunity?   Remember,  it will be suicide for BN if the palace do so.  

Najib during an earlier briefing to the media,  said,  it is the discretion of the palace to dissolve the Perak state  assembly .   The ball now is in the palace’s court.    We urge the palace to make a right and correct decision this time.   There is news,  the Regent of Perak, Raja Nazrin has agreed to meet DS Nizar tomorrow.

KUALA LUMPUR:   The High Court here ruled on Monday that Datuk Seri Mohammad Nizar Jamaluddin is the rightful Perak Mentri Besar,  and not Barisan Nasional’s Datuk Seri Dr Zambry Abdul Kadir.

In an immediate response,  Zambry said he would apply for a stay pending appeal.   This was rejected by the court.

The court also ordered Zambry and the six executive councillors he had appointed to vacate their office.

An aide to Dr Zambry told the media that Perak Barisan Nasional will respect the court order and will vacate their offices at the state secretariat building immediately.

He added that Dr Zambry is on his way to Kuala Lumpur from Ipoh. Dr Zambry could not be reached for comment at press time.

Nizar left the courtroom saying he would seek an audience with the Sultan of Perak, Sultan Azlan Shah,  to get his consent to dissolve the Assembly and call for fresh state elections.

He would make his request for the audience at a state function at the Istana Kuala Kangsar Tuesday morning.

In his ruling Monday,  Justice Abdul Aziz Abd Rahim said that a new mentri besar could not be appointed as the office had not been vacated.

He said a mentri besar can only be dismissed by a vote of no confidence, and upheld the Stephen Kalong Ningkan ruling.

He noted that the Perak State Legislative did not hold a vote of no confidence.

In 1966, Sarawak Chief Minister Datuk Stephen Kalong Ningkan was ousted when the state governor showed him a letter of no confidence issued by 21 out of 42 legislators and asked Ningkan to resign.

Ningkan refused,  saying the letters were not tantamount to a vote of no confidence in the state legislative assembly. He was sacked by the governor but eventually reinstated by the Borneo High Court, which saw the necessity of a formal vote of no confidence.

According to the Nutgraph,  the judge ruled ruled that the governor can only dismiss the chief minister when both these conditions are satisfied:

(a) The chief minister has lost the confidence of the House, and

(b) The chief minister has refused to resign and failed to advise a dissolution.

Nizar had filed for a judicial review on Feb 13,  seeking a declaration that he is the rightful mentri besar of Perak and an injunction to bar Dr Zambry from discharging his duties as the mentri besar.

On March 6,  Justice Lau Bee Lan had ruled that there were constitutional issues involving the interpretation of Article 16 (6) of the Perak Constitution and later referred four consitutional questions to the Federal Court for determination.

However,  on March 23, the Federal Court ruled that the case of who the rightful mentri besar is should be heard by the High Court.

Nizar’s lead counsel Sulaiman Abdullah, in wrapping up his submissions last week, said the Constitution was the “genius of the Malaysian people”,  adding that the court had a duty to uphold it.   Over the last few days, he had submitted that the Sultan,  while granted powers in the Perak Constitution to appoint a mentri besar,  could not dismiss him.

The only way Nizar could be dismissed,  he said,  was through a vote of no-confidence in the House.

He also said that a mentri besar could request for the State Assembly to be dissolved in the middle of a term without losing the confidence of the majority of the House.

Dr Zambry’s lawyer Datuk Cecil Abraham,  however,  argued that Nizar went by Article 16(6) of the Perak Constitution when he sought an audience with the Sultan – this article specifically provides for the mentri besar to request for a dissolution when he has lost the confidence of the majority in the House.

I think we have to read the lines in between the  Perak assembly rampage by BN and the olive branch offered by Tun Najib yesterday.

On 7th May BN buldozed through the Perak assembly to install a new speaker.   Sivakumar,  the lawful speaker was manhandled and forcibly thrown out of the Perak state assembly.   This episode left a very disgraceful perception of the ruling party among Malaysians.

Yesterday evening I was sipping teh tarik in a  24 hours restoran.  There were a few of my friends who were staunch BN supporters also having tea.  I purposely put up a few questions regarding the Perak assembly fiasco.    If before this they vehemently defended Zambry’s government,  now they were a sort of speechless.   No answers came from them.   I suppose these BN supporters also did not anticipate Zambry can go over-board this far.

Malaysians might be wondering how BN can go to the extend of using an executive tool, the police,  to ransack the Perak assembly.   This shows how short sighted Zambry is when he could not foresee the after effect of his cunning scheme.

BN lost five states during the 12th general elections and another four by-elections.  The majority of the rakyat  are disillusioned by the BN.   They have lost confidence in them.    Now,  how does BN think they can win back the support of the rakyat by taking over the Perak assembly by the use of force?  The BN’s  image is now in shambles!

Maybe this is why Tun Najib offered to have dicussions with the opposition to solve the Perak crisis.   Najib is trying to soften his approach towards the opposition but the damage has already been done.   Video clip showing Sivakumar being dragged out in a humiliating  manner has already been broadcasted throughout the world in the youtube media.

However,  BN is definitely not going to give up the Perak government.   Giving this, what sort of discussion Najib is going to have with the opposition.  I am very sure pakatan wants the Perak assembly to be dissolved.   I doubt any discussions held in this environment will yield any results.

But there are also words that the BN might want the palace to take the initiative to dissolve the assembly rather than a BN requested one.  This is still uncomfirmed news.

I am still figuring out what transpired on 7th May perak assembly power grab.  A very disgusting episode which I believe did not even happened in a communist or a socialist country and putting democracy to shame.

I just do not know where to start.    For the past two days I have been going through all the reports and comments on the web and blogs.  All of them seemed astonished the way the power grab has been done.   Maybe nobody anticipated the police will be used to overthrow the presiding speaker.

The 7th May assembly sitting is illegal from the beginning because it was not authorized by the speaker.  It is also illegal because the notice for the assembly was issued by a suspended secretary under the instruction of an illegal MB who’s legality as the Perak MB is still pending in the courts.

When the sitting is illegal according to the rule of law, the whole assembly is considered null and void.    I agree with MB Nizar Jamaludin in that case.  In other words it is considered that no state assembly meeting has ever taken place !

When the assembly sitting began,  Sivakumar as the lawful speaker ordered the seven suspended and three,  assumed to have resigned assemblymen,  to leave the assembly hall.  Since Sivakumar is the legal speaker at the moment,  the ten should abide by the ruling.  Sivakumar stressed that he will not begin the assembly proceedings until the ten left the assembly hall.   This means the assembly cannot begin until all the mentioned assembly persons has abided by the speaker’s instruction.  The ten did not abide the ruling which also means the assembly has not begun until it was adjourned at 4.05 in the evening !

You see,  it is a very simple argument,  any Tom,  dick and Harry can understand but Zambry, Hamidah and Hee could not understand.   I do not know at which juncture Hee Yit Foong,  the deputy speaker intervened and took over from Sivakumar because what I know is such juncture did not occur.

Hee has claimed in the media that she did so according to the Article 36A(1)(b) which states: “that in the absence of a Speaker,  the Deputy Speaker shall preside until the appointment of a new Speaker”.    This Article only allows Hee to preside the assembly at the absence of a lawful speaker but the lawful speaker was sitting on the speaker’s seat right in front of her!  This a former DAP assemblywoman.  DAP, do you have any comment on this?   Did you properly vet or screen this lady?  You have proposed and elected a deputy speaker who can’t even understand the Perak state assembly standing orders !  

Raja Muda perak,  Raja Nazrin’s address did not give legitimacy to the assembly sitting since he addressed the assembly when the lawful speaker was forcefully draged out and prisoned in a changing room within the premise of the state assembly building.   Raja Nazrin,  I think should not be blamed because he might had come to the house assuming everything is moving smoothly according to the rule of law.   Or maybe that was what Zambry had related to his highness.

It is very evident that everything that transpired on 7th May was masterminded and planned before hand by the illegal MB,  Zambry Abd. Kadir with the consent of the Prime MInister,  Tun Najib Abd.Razak.   First we saw all BN asemblypersons did not obey the speaker,  maybe they were instructed to do so.   Then we saw Zambry putting up a motion to suspend  Sivkumar when the assembly had not even started to convene. The sergeant-in-arms did not obey the speaker’s intrucction to remove the ten assemblymen but obeyed the illegal speaker, R Ganeson’s  instruction to remove the lawful speaker.   Again this might be part of their plan.

Sivakumar’s mike was off which means the officials of the state building was instructed to do so while Zambry’s mike and Hee’s mike was on so that they can proceed with their plan.   So,  now only Zambry’s voice and Hee’s voice can  be heard.  That’s the plan.  The BN asemblypersons flocked to a corner in the assembly hall and Hee went on to appoint the irrelevent MIC’s R. Ganeson as the speaker.   All this was happening while the lawful speaker was seated right in the  speaker’s seat!

Now,  there are reports that the police actually played a very important role in this hijack.  Idham Lim,  the Titi Serong assemblyman estimated on his blog that around 300 police personals were mobilised to take part in the power grab.  I don’t think they simply came for security reason but was part of Zambry’s plan to siege the Perak assembly.  These police personals was also acting as officials in the assembly when they were wearing the officer’s name tags.  And later they were seen dragging out Sivakumar out of the assembly hall.

The Perak  assembly building and it’s  compound is a no-entry zone for the police.  Anything that happened within  this zone should be solved by the assembly members and officials.  When  Karpal Singh was recently man handled at the parliament building, the IGP,  Musa Hasan said the police  could not intervene in the parliament zone even if there was a fight going on in the assembly chamber.   Then,  how come the police stormed the Perak assembly hall to throw out the legal presiding speaker.  Who is correct here, the IGP or the Perak police?

This is what conspired on the 7th May at the Perak assembly Hall. A very dark day for democracy.   Ragunath Kesavan, the Bar Council president is correct when he said it was a bleak day for democracy and stressed the only way to come out from this stalemate is by dissolving the state assembly.

Hee Yit Foong was the culprit behind the BN take over of the Perak state assembly.

She was right in the middle of  Zambry’s mastermind plan to run over the Perak state assembly.   Since she was the deputy speaker,  Zambry used her to run the whole procedure to topple the lawful speaker,  Sivakumar.

Today she gave her reason why she intervened and took over from Sivakumar.   In her broken bahasa malaysia she explained that because Sivakumar could not handle the situation in the assembly,  she can intervene according to the assembly’s standing order Article 36A(1)(b).

Article 36A(1)(b) states:   ” that in the absence of a Speaker, the Deputy Speaker shall preside until the appointment of a new Speaker ”    Where does this standing order ever  gives her any power to intervene especially when the lawful assembly speaker is seated in the assembly seat right in front of her.   Is she blind ?  Does she really understand what is a standing order is in the first place? 

If she understands the standing order,  then she would not have intervened because  Article 36A(1)(a)  says that a deputy speaker shall be apointed from among the members of the assembly.   But her court case regarding whether she and two other assemblymen has resigned or didn’t resign is still pending in the courts.  In that case she should not even be present in the state assembly because her legality as a  member of the assembly is questionable.  What if the court rules that she had already resigned?

You may say that all what she had said  is rubbish,  but that is  what the prime media channels was airing tonight.  If she had managed to control the assembly than why did the police has to strangle Sivakumar out of the dewan?

Remember,  on the eve of the sitting,  she was with Zambry.   Now we know  what she was doing with Zambry.   They were masterminding the commonwealth countries’s  first ever assembly siege !   I think she is worth the amount of money BN has spent on her.   She did not dissapoint them.

Without Hee, as the deputy speaker,  BN could not have accomplished their mission.  They call her a frog,  indeed a very poisonous frog !

It was reported today, that 13 ISA detainees will be freed soon.  It is a suprise move  since  BN was all for arrest  as we noticed in Ipoh yesterday.

Home Minister Datuk Seri Hishammuddin Tun Hussein said three Hindraf leaders,  M. Manoharan, P. Uthayakumar and K. Vasantha Kumar are among the 13 ISA detainees to be freed.   He added he would sign the documents on Friday. 

M.Manoharan is also the state assemblyman for the Alam Shah state constituency.  He has earlier expressed that he might decide to vacate the state seat prompting for a by-election.  He said since he is in detention he could not properly serve his Alam Shah constituency.

Earlier the Selangor MB,  Datuk Khalid has said that the Selangor government want to have an audience with the home ministry to discuss the release of M. Manoharan since he was their state assemblyman and probably to avoid another by-election.

After losing four by-elections,  BN announced they might not contest the Penanti seat state by-election.  Even though it was seen as BN may want to avoid another defeat,  Mahathir and some other BN leaders said they should be contesting.   BN will have a meeting with all component parties before deciding to contest the seat.

When M. Manoharan said he wants to quit the Alam shah seat    means BN have to face another by-election.  They don’t want to have another by-election and go through another ordeal.  They do not want to lose another by-election.

Is this the reason why BN are releasing  the 13 ISA detainees?   Of course,  if they only release M. Manoharan,  it will be very  obvious that their reason for the release is to avoid another by-election.  So,  when you release 13 of them it might not be seen as one.

Whatever is the reason pakatan rakyat has won this session.  If this is their strategy, then it has worked. 

Yesterday the BN rampaged the Perak state assembly leaving all Malaysians baffled.  Today,  the  releasing of these ISA detainees  might be for damage control !

The Perak assembly was taken over by BN with  the use of  the police force.

The lawful  assembly speaker,  Sivakumar,  was reported being ruthlessly dragged out of the assembly by the police even though the state assembly is a ‘police no go area’.   The BN appointed the former Sungkai assemblyman,  Ganeson as the new illegal speaker.   The word  ’illegal’  is gaining momentum in the Perak state assembly.

Before this,  there was the illegal MB,  the illegal speaker’s secretary,  the illegal state assembly on 7th May and now the illegal speaker and many more illegal things because all this was done by illegal persons.   All state assembly sittings after this will be illegal since it will be insructed by an illegal speaker.  I am very sad because BN used the Raja Muda of Perak to officiate this illegal sitting.

We salute the brave aduns of pakatan who until 3.15 pm on 7th May,  bravely resisted the mighty BN from taking over the assembly.  At last BN has to resort to bringing in the police to force the pakatan aduns to give up their resistance.  What a brave deed you all did to defend democracy and the rule of law !

I had said in my earlier article that what ever conspires in the assembly today,  Speaker Sivakumar will be the man of the day and he was.

Perak Pakatan aduns,  you did not lose,  but democracy and the rule of law was defeated today.   It is a shameful day for Najib Tun Razak because something like this happened under his reign.  Many generations to come Malaysians will be talking about this dark day for democracy.

According to a report released by the star online just now,  the media interviewed   Zambry in Ipoh  regarding tomorrow’s Perak assembly sitting.

But,  it is not what zambry told the reporters that is the centre of attraction here,  but the media also reported that,  Ipoh’s most popular frog,  Hee Yit Fong who is also the deputy speaker was present there with Zambry.

Why do you think Hee is with zambry on the eve of the Perak assembly sitting.  Are they planning something for tomorrow ?    Will there be a big surprise tomorrow?  Is Zambry coaching Hee who might be the speaker tomorrow?

This information is coming in after all the arrests and police cautions to the public.

It is black magic, the high court and the police who are  in play to put Zambry as the MB on 7th May.

All these informations are from blog reports in the past few days.  Idham Lim, the Titi Serong assemblyman, posted statements on his blog that he has proof where black magic was used and a ‘bomoh’ was brought into the state assembly chamber.  He also reported that police were coming to pakatan state assemblyperson’s houses and clicking photographs.

If all these allegations were true, we  wonder why is black magic been used.  May be they want to put a spell on speaker Sivakumar so that on the 7th May sitting, he will go dizzy and give in to all BN’s demand.  It looks crazy to say that, but as Zambry and BN are very desperate to get things moving in their direction, I believe they are ready to do anything for power.

We do not know why are the police coming to assemblypersons homes to take pictures.  May be they want to intimidate them.  

In other developments,  Wong Chin Huat ,  from the NGO Bersih,  was remanded for a day  by  the Kuala Lumpur magistrate court under the Sedition Act which is believed due to Bersih’s campaign for people to wear black on 7th May.   It is to protest the convening of the Perak assembly.   PKR youth leader,  Badrul Hisham is as also reported being arrested.   In the latest development Pas leader,  Hj. Mohd.  Sabu was arrested in Kuala Lumpur .  It is believed that he was arrested because his call to all pakatan supporters for a mass prayer in Ipoh in the early morning of 7th  May.   But what is obvious, they are using all avenue at their disposal to make a fruitful day for Zambry and BN on 7th May.

The court case regarding who is the rightful MB is  in session at the high court as I am writting this artical.  I am not very sure whether the case can be settled by 7th May before the Perak state assembly sitting is convened.  But will it favour the BN?  Is the court also being used as another tool?   If it favours them, it is another additional boost for BN and Zambry to usurp the Perak state leadership. 

I have a feeling that the environment  now is like,  we are back in Mahathir regime’s time, where police arrests and disputed court rulings are rampant.   Can pakatan overcome the ‘seen’ and ‘unseen’ forces on 7th May?

Perkembangan dalam pas sejak pilihanraya umum ke12, lebih tertumpu kepada perbezaan diantara aliran yang hendak berkerjasama dengan BN dan umno dan  aliran yang hendak terus bersama parti pembangkang.

Perkara in telah pun dibahaskan dikalangan ahli-ahli serta pemimpin pas dengan meluas.  Ramai pemimpin pas telah menafikan dimedia bahawa masalah ini wujud.   Tetapi, apabila  pemilihan pimpinan dalam mesyuarat- mesyarat agung kawasan diadakan,  isu ini telah dizahirkan dan nampak lebih jelas.

Kita melihat memang wujud apa yang disebut sebagai puak edrogan dan pro-muzakarah.   Puak edrogan disifatkan sebagai mereka yang hendak kekal bersama parti-parti pembangkang dalam pakatan rakyat.   Puak pro-muzakarah pula disifatkan sebagai mereka yang setia kepada pemimpin pas dan akan memberikan ketaatan kepada mana-mana  keputusan yang dibuat oleh mereka.    Saya mengatakan begini kerana saya berpendapat,  ramai di kalangan pro-muzakarah juga tidak mahu pas bekerjasama dengan umno atau BN tetapi hanya akur kepada keputusan pemimpin mereka.

Setelah mesyuarat pas kawasan-kawasan diadakan,  kita melihat trend anti-muzakarah amat jelas apabila ada pencalonan menentang pimpinan pas yang pro-muzakarah pada   pemilihan pas pusat nanti dan ada pas kawasan langsung tidak buat pencalonan untuk kerusi presiden dan timbalan presiden.   Ada juga kawasan yang hanya mencalonkan untuk kerusi timbalan president tetapi tidak untuk jawatan presiden.  Presiden pas TG Hj. Abdul Hadi Awang adalah pemimpin pro-muzakarah. 

 Apakah kawasan-kawasan yang tidak menclonkan beliau tidak mahu beliau sebagai presiden?  Bolihkah ini disifatkan sebagai protes kepada aliran pro-muzakarah?    Apabila ini terjadi,  pas pro-muzakarah mula menjadi cemas.   Maka meletuplah kenyataan dari Hj. Nik Abduh yang pro-muzakarah, di dalam blognya yang mengatakan ayahnya,  Tuan Guru Hj. Nik Abdul Aziz,  telah dikelirukan oleh mereka yang rapat dengannya  sehingga beliau   menolak kerjasama dengan umno dan kerajaan perpaduan.   Siapakah yang dimaksudkan sebagai mereka yang rapat dengan TG Nik Aziz, tidak dijelaskan.

Ramai pemimpin pas tersentak dengan tuduhan nik abduh.   Banyak kenyataan telah dibuat kepada media olih pemimpin-pemimpin dari kedua aliran dalam pas itu. Nampaknya,  aliran edrogan mempunyai pengaruh yang meluas dalam pas.   Kemungkinan ramai pemimpan aliran pro-muzakarah akan lenyap dalam pemilihan pucuk pimpinan pas yang akan diadakan di Shah Alam tak lama lagi.   Ramai juga telah KO dalam pusingan pertama apabila diadadkan pemilihan diperingkat pas kawasan.

Kita nak lihat apa akan terjadi kepada Dr. Hassan Ali,  pesuruhjaya pas negeri Selangor, yang menjadi orang kuat dalam aliran pro-muzakarah.   Apakah beliau dapat kekalkan kedudukannya dalam hiraki pimpinan pas atau nasibnya sama seperti sahabat-sahabat beliau dalam aliran pro-muzakarah?

On 7th may, the most strangest assembly sitting in the world will be convened in Ipoh, Perak.  This is supposed to put Malaysia back into the guiness book of records after the ‘tallest’ and ‘longest’ during the Mahathir regime.

This is an assembly sitting whereby both the BN and Pakatan knows it is an illegal sitting , yet both parties are ready to go through it.   If it is an illegal sitting, then,  will the decisions made during the session be legitimate?

There is a pending court case on the 5th and 6th May regarding the  MB  of Perak.  Who will be ruled as the legitimate  MB of perak is still in the hands of the court.  I don’t think this case will be settled on 6th May.    If that is the case, then who will be assumed as the MB on 7th May.    How is an assembly convened without a MB ?

The only legal persons in the 7th May illegal sitting will be the speaker and the 58 aduns.   Will the seat for the MB in the assembly chamber left unseated?    Whom will the speaker instruct to take the MB’s seat on that day?    We assume that it will be Nizar Jamaludin.    Then, what will Zambry do?   He claims that he is the MB since the palace says so.   But the palace keeps it’s silence while the state under it’s reign is near devastation due to the political unstability !

Now there are three persons who are running the state assembly.   They are Zambry, the state secretary and the suspended secretary of the Perak speaker, Abdullah Antong.   The three do not have any authority to instruct for an assembly sitting.    The person who should call for a sitting is Sivakumar,  the undisputed speaker of the Perak state assembly.  But he has said that no instructions were given to call for a sitting.  The sitting was called without his knowledge.

I think, after taking all these  into consideration and the difficulties he will be facing on 7th May,  Sivakumar is correct when he sent a notice to the palace to adjourn the assembly sitting  yesterday.  

Well, let’s see whether the legitimate speaker’s or the disputed MB’s voice is heard in the palace.

I just can’t understand what Penang Pas really wants. They are hard after the Penanti state seat vacated by PKR Fairus Jamaludin.

Penang Pas now says they are going to nominate it’s own candidate.  Earlier demand was denied by the pas election director,  Hj. Mustafa Ali.

They say they are not satisfied in the way Fairus was resigned.   What they should do is, they discuss the matter with other pakatan component parties and their leaders but not propose their own candidacy on the media.   The Fairus resignation issue is already in a mess.   This will add more mud to the already muddy scenario !

The star online today reported that Penang Pas insisted they are going to field a candidate.   Pas Penang deputy commissioner,  Dr. Mujahid Yusof Rawa has said this is done to restore the tarnished image of pakatan rakyat after the Fairus resignation fiasco. Did Dr. Mujadid forgot that pas is also part of pakatan rakyat.   If you say pakatan’s image is tarnished,  you are actually saying that, Pas, PKR and DAP’s image is tarnished.  Do you get it ! Or actually you have other reasons which you are not mentioning here.

There was also words from Permatang Pauh pas division that prior to the 12th general election the seat was contested by pas, so they want the seat back.   They also want Pas leadership to reallocate the Penang assembly seats among the pakatan components.   I feel this is nonsense and this is not the time to talk about it.  Let the election go on first.

Don’t be childish !  Penang Pas,  where is the pakatan unity?   Where is the cooperation and understanding that you should be showing?   Remember, you are the most senior party among all the pakatan components.
